1. Scope and Conclusion of Contract
These General Terms and Conditions apply to the rental provision of the holiday accommodation offered by the hosts and to all related services.
The accommodation contract is concluded upon confirmation of the booking by the hosts or, in the case of a booking made via a booking or intermediary platform, in accordance with the booking process provided by that platform.
Individual agreements made between the hosts and the guest shall take precedence over these General Terms and Conditions.
If a booking is made via an intermediary or booking platform and different payment, cancellation or other booking conditions have expressly been agreed there, the conditions agreed on that platform shall apply to the relevant matter.
2. Arrival and Departure
The accommodation is available to the guest from 12:00 noon on the day of arrival.
The accommodation must be vacated by no later than 11:00 a.m. on the day of departure.
Different arrival or departure times may be agreed individually.
Late arrival or failure to arrive does not automatically cancel the accommodation contract or the resulting payment obligations.
If the accommodation is returned late on the day of departure without prior agreement, the guest may be charged any additional costs actually incurred as a result or any compensation for continued use required by law.
3. Payment
Unless otherwise agreed, a deposit of 50% of the total price must be paid within 14 days after receipt of the booking confirmation or invoice.
The remaining balance is due no later than 30 days before arrival.
For bookings made less than 30 days before the arrival date, the entire invoice amount is due upon receipt of the invoice.
If payment is not made on time, the hosts may withdraw from the contract and re-let the accommodation after an unsuccessful request for payment and the expiry of a reasonable payment deadline.
Additional charges for water, electricity, heating, waste disposal and the use of parking spaces provided for the accommodation are not charged separately unless otherwise agreed in the booking confirmation.
Any other services included in the agreed accommodation price are specified in the respective booking confirmation and description of services.
4. Cancellation by the Guest
The guest may cancel the contract before the start of the stay. For clear documentation, cancellation should be made in text form, for example by email.
Cancellation is free of charge up to and including 30 days before the agreed arrival date.
If the booking is cancelled less than 30 days before the agreed arrival date, the hosts' claim to the agreed accommodation price generally remains in place if the accommodation is not used for reasons attributable to the guest.
However, the hosts must take into account any expenses saved as well as any income received from re-letting the accommodation.
If the accommodation can be fully re-let for the cancelled period under at least equivalent conditions, the guest will not incur cancellation charges, except for any additional costs actually incurred and verifiable.
The guest remains entitled to demonstrate that the hosts suffered no financial loss or a substantially lower financial loss.
The guest may propose another person to take over the contract in their place. The transfer of the contract requires the consent of the hosts. Consent may in particular be refused if there are objective reasons against accommodating the proposed replacement guest.
In the event of failure to arrive without prior cancellation or in the event of early departure initiated by the guest, the above principles shall apply accordingly.
Any statutory rights of withdrawal, termination, reduction of price or other legal rights of the guest remain unaffected.
5. No Statutory Right of Withdrawal
For contracts relating to the provision of holiday accommodation on a specific date or within a specific period, there is generally no statutory 14-day right of withdrawal pursuant to Section 312g(2) No. 9 of the German Civil Code (BGB).
The cancellation option provided under Section 4 above remains unaffected.
6. Occupancy and Use of the Accommodation
The accommodation may only be occupied by the number of persons stated or agreed at the time of booking.
Additional unregistered persons may stay overnight only with the prior consent of the hosts.
Re-letting, subletting or any other provision of the accommodation to third parties for payment is not permitted without the prior consent of the hosts.
The accommodation may only be used for the agreed accommodation purpose.
Parties, events or comparable gatherings are not permitted without the express prior consent of the hosts.
Appropriate consideration must be shown to neighbours and other guests. Statutory and local quiet hours must be observed.
7. Non-Smoking Accommodation
Smoking is expressly prohibited in all indoor areas of the holiday accommodation.
The smoking ban also applies to electronic cigarettes, vapes and comparable products.
Smoking is permitted only in suitable outdoor areas. Cigarette butts and other smoking-related waste must be disposed of properly.
If a culpable breach of the smoking ban results in additional cleaning, odour treatment, repair or other costs, the hosts may charge the guest the costs actually required.
8. Pets and Assistance Dogs
Pets are not permitted in the holiday accommodation. This applies in particular to dogs.
Pets may neither be brought into nor accommodated in the property.
There is no entitlement to bring or accommodate a pet.
If a pet is brought along contrary to this agreement, the hosts may refuse to allow the animal into the accommodation.
If a culpable breach of the pet prohibition results in additional cleaning costs, other costs or damage, the hosts may claim the costs actually required and verifiable.
Statutory rights of persons with disabilities accompanied by a recognised assistance dog remain unaffected.
9. Duties of the Guest and Careful Treatment
The guest undertakes to treat the holiday accommodation, including its inventory, furnishings and outdoor areas, carefully and with due care.
The accommodation and its facilities may only be used for their intended purpose.
Furniture and other items may generally not be removed from the accommodation or substantially rearranged without the consent of the hosts.
The guest is responsible for ensuring that accompanying persons also comply with these obligations.
When leaving the accommodation, windows and doors must be properly closed. Fire, heat sources and electrical equipment must be handled responsibly.
10. Damage Caused by the Guest
The guest is liable in accordance with statutory provisions for damage culpably caused by the guest or by persons brought into or accommodated in the property by the guest.
The guest is not liable for changes, wear and tear or deterioration resulting from ordinary and contractual use of the accommodation.
Damage or defects caused or discovered during the stay should be reported to the hosts as soon as possible so that further damage can be prevented and any necessary repairs can be arranged.
Damage or defects already apparent upon arrival should likewise be reported as soon as reasonably possible.
The mere fact that damage is discovered during or after a stay does not automatically establish liability on the part of the guest.
11. Defects and Complaints
If a defect or significant disruption occurs during the stay, the guest must inform the hosts without undue delay.
Where reasonable and possible, the hosts must be given the opportunity to remedy the problem within a reasonable period of time.
If the guest culpably fails to report a defect where notification was required and this prevents a remedy from being provided or further damage from being avoided, the consequences shall be governed by the applicable statutory provisions.
Statutory rights of the guest relating to reduction of price, damages, termination or other remedies remain unaffected.
12. Keys and Access Data
Keys, transponders or access codes provided to the guest must be kept safe and, where applicable, treated confidentially.
Keys, transponders or access codes may not be passed on to unauthorised third parties.
The loss of keys or other means of access must be reported to the hosts without undue delay.
If the loss is culpably caused by the guest, the guest is liable for the actual costs required for replacement and, where necessary for security reasons, for necessary changes to or replacement of locking components.
13. Access to the Accommodation During the Stay
The hosts respect the guest's privacy during the stay.
Where there is an objective reason, in particular for carrying out necessary repairs, preventing imminent damage or checking a reported fault, the hosts or a person authorised by them must be granted access to the accommodation after prior consultation with the guest.
In the event of imminent danger, in particular fire, water, gas or other significant hazards, the accommodation may also be entered without prior consultation where this is necessary to avert danger.
14. Departure Condition
The accommodation must be left in an orderly condition upon departure.
Personal belongings must be removed.
Waste must be disposed of in the containers provided.
Used dishes, cutlery and kitchen utensils must be left cleaned or placed in the available dishwasher.
Extraordinary soiling that exceeds the level normally expected from ordinary use and was culpably caused by the guest may be charged according to the actual additional cleaning effort required.
15. Outdoor Areas and Facilities Provided
The garden, outdoor areas and any leisure, play or other facilities provided must be used for their intended purpose and with appropriate care.
Use is at the guest's own responsibility, taking into account their own abilities and the local conditions. The liability of the hosts is governed by Section 18 of these General Terms and Conditions.
Children may use facilities that require supervision due to their nature only under appropriate supervision by a parent, guardian or other person responsible for supervision.
Plants, shrubs and other parts of the outdoor areas must not be damaged or altered without consent.
Where fruit or berries have expressly been made available for picking by the hosts, they may be harvested in normal household quantities for personal consumption. Plants and shrubs must be treated carefully.
16. Description and Equipment of the Accommodation
Photographs and descriptions published on the website, booking platforms, brochures or other materials are intended to provide as realistic a representation of the respective accommodation as possible.
Minor deviations may occur, for example in decorations or individual furnishings.
The hosts are entitled to replace individual items of equipment with items of at least equivalent quality, provided that this does not adversely affect the agreed use, character or essential features of the accommodation.
The guest's statutory rights in the event of significant deviations or defects remain unaffected.
17. Disruptions and Extraordinary Events
If the booked accommodation cannot be provided as contractually agreed for reasons for which the hosts are responsible, the applicable statutory provisions shall apply.
If the accommodation cannot actually be provided or used due to an extraordinary event beyond the control of either party, the rights and obligations of the parties shall be governed by the applicable statutory provisions.
Payments already made will be refunded insofar as the guest is not obliged to pay for the relevant period.
Where possible, the hosts may offer the guest alternative accommodation. The guest is not obliged to accept such an alternative if it does not correspond to the contractually agreed service.
18. Liability of the Hosts
The hosts are liable for damage suffered by the guest only where the hosts are responsible under the applicable statutory provisions.
In particular, the hosts are not liable for damage caused by the guest themselves or resulting from improper, careless or unintended use or behaviour by the guest or accompanying persons.
Any contributory negligence on the part of the guest shall be taken into account in accordance with the applicable statutory provisions.
The hosts are fully liable for damage caused intentionally or by gross negligence by the hosts, their legal representatives or persons employed by them in the performance of contractual obligations.
The hosts are also liable in accordance with statutory provisions for culpable injury to life, body or health.
In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the damage that is typical for the contract and reasonably foreseeable. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the guest may normally rely.
Otherwise, liability for damage caused by slight negligence is excluded to the extent legally permissible.
The hosts are liable for the guest's personal belongings, valuables, bicycles or vehicles only where the hosts are responsible under the applicable statutory provisions.
Mandatory statutory liability provisions remain unaffected.
19. Data Protection
The guest's personal data is processed insofar as this is necessary for the performance of the accommodation contract, communication with the guest and compliance with legal obligations.
Further information on the processing of personal data can be found in the Privacy Policy published on the website.
20. Final Provisions
Individual agreements made between the guest and the hosts shall take precedence over these General Terms and Conditions.
Changes or additions to individual agreements should, for better evidentiary purposes, be recorded in text form, for example by email.
The law of the Federal Republic of Germany shall apply. Mandatory statutory provisions, in particular mandatory consumer protection provisions, remain unaffected.
The place of jurisdiction shall be determined in accordance with the applicable statutory provisions.
If any provision of these General Terms and Conditions is or becomes wholly or partially invalid, the remainder of the contract shall remain valid. Where a provision is invalid or has not become part of the contract, the applicable statutory provisions shall apply in its place.
